LUBBOCK, Texas (KCBD) — A 40-year-old Lubbock man has been sentenced to 45 years in prison for the death of a 2-month-old baby and for firing at police during a standoff in 2023.
David Garcia was sentenced on Thursday after being convicted for his role in the infant’s death and a violent encounter with law enforcement. In April 2023, police were called to Covenant Women’s and Children’s Hospital to investigate the baby’s death. The child’s mother told authorities that Garcia had brought the unresponsive baby to the emergency room after calling her about the child’s condition. Garcia reportedly left the baby at the hospital before fleeing the scene.
Two days later, on April 22, Lubbock police received a call about an armed man threatening self-harm. Officers set up a perimeter and evacuated nearby residents. Garcia barricaded himself inside a home and began firing at police. After hours of negotiations and the deployment of chemical gas, the standoff ended, and Garcia was taken into custody.
Garcia faces charges for aggravated assault of a family member and two counts of aggravated assault against a public servant. Each charge carries a 45-year sentence, which will be served concurrently.
