A Florida grandmother, Tracey Nix, has been acquitted of manslaughter in the tragic death of her 7-month-old granddaughter, but was convicted on a lesser charge related to the incident.
The Tragic Incident
The unfortunate event took place in November 2022, when Tracey Nix was entrusted with the care of her granddaughter, Uriel Schock. After a lunch with friends, Nix unknowingly left Uriel in her car for several hours on a hot day. The temperature reached 90 °F, and Uriel tragically succumbed to hyperthermia.
A medical examiner confirmed that hyperthermia was the cause of death. This loss was not the first tragedy for Nix, as her grandson, Ezra, had drowned in a pond after wandering off while Nix was asleep. However, the court ruled that jurors would not hear about Ezra’s death during the trial.
Legal Proceedings
The prosecution charged Nix with aggravated manslaughter of a child, arguing that her negligence amounted to criminal behavior. On the other hand, Nix’s defense attorney maintained that the death was an accident. Ultimately, the jury in Polk County found Tracey Nix guilty of leaving a child unattended in a vehicle for more than 15 minutes, leading to great bodily harm. However, they acquitted her of the aggravated manslaughter charge.
Mixed Reactions from the Family
The verdict left Uriel’s parents with mixed emotions. Drew Schock, Uriel’s father, said, “It does sting, but I’m thankful though that we did get something.” Her mother, Kaila Nix, shared her relief, saying, “I was relieved to hear that there was going to be accountability and ownership and a conclusion to this part of the story. One of the things that we have struggled with through this whole case has been the exclusion of my other story, which is my son who drowned in her care.”
Legal Defense and Next Steps
Following the verdict, Bill Fletcher, Nix’s defense attorney, considered the acquittal of aggravated manslaughter a “win,” but stated their intention to appeal. He emphasized that the judge did not allow “intent” to be included in the jury instructions for the charge on which Nix was convicted. Tracey Nix is set to be sentenced in April and faces up to five years in prison.
