Fellers Receives Maximum Sentence for Baby’s Death

CHARLES TOWN — John Fellers was sentenced to 15 years to life for the death of his 37-day-old son, Joshua, after being convicted in April for child abuse resulting in death.

Fellers appeared in Judge David Hammer’s courtroom on Monday for sentencing. Attorney James Kratovil represented Fellers, while assistant prosecutors Adam Ward and Greg Jones represented the state.

Evidence presented during the trial showed that Fellers had shaken Joshua in February 2023, leading to the baby’s death from abusive head trauma.

Robin Sims, Joshua’s grandmother, delivered a victim’s statement, often breaking into tears. She described the joy of having grandchildren and the pain of losing Joshua. Addressing Fellers directly, Sims expressed her grief and anger, saying they should be spoiling their grandson, but instead, they visit his grave.

Sims also mentioned that her daughter, Angel Sims, is in prison because of Fellers’ actions. She criticized Fellers for being more concerned with his video games than his child and stated she could not forgive him at this time.

Prosecutor Ward requested the maximum sentence, emphasizing the suffering of the child and Fellers’ lack of remorse. He asked for a life sentence without parole and a 50-year supervised parole if Fellers were ever released.

Kratovil argued that Fellers was young and could change over time, asking the judge to avoid recommending a life sentence or the 50 years of supervised parole.

Fellers made a brief statement expressing regret and his willingness to accept punishment. He claimed to have loved his son unconditionally.

Judge Hammer rejected the notion that Fellers’ youth excused his actions. He noted that Fellers tried to hide evidence and was not a loving father. Hammer sentenced Fellers to the maximum of 15 years to life, recommending a life sentence and prohibiting Fellers from accessing video games. Hammer also agreed to 50 years of supervised parole if Fellers were ever released and ordered him to pay $3,117 in restitution for Joshua’s headstone and funeral expenses.

Angela Sims, Joshua’s mother, was sentenced last month to three to 15 years in prison after pleading guilty to child neglect resulting in death. Both sentences require minimum service before parole eligibility—three years for Angela Sims and 15 years for John Fellers.
